| Attempting mediation and arbitration before
entering into a court dispute could save your business time and costly
legal fees. However, the use of mediation and arbitration agreements
outside the collective bargaining arena is open to much debate.
This clause can be placed in an employee handbook, but it should also be separately signed by your employees as its enforceability may be diminished due to the numerous disclaimers that many employee handbooks contain. Additionally, having this agreement separately signed shows that the employee independently reviewed the document as opposed to its inclusion in a company handbook.
